Section 45 Modern Slavery Act Defence success for Tomas McGarvey

Tomas McGarvey instructed by Aashar Malik of Woolfe & Co Solicitors successfully represented a man charged with two counts of possessing a controlled drug of class A with intent to supply, and one count of possessing a controlled drug of class B with intent to supply.

The Prosecution case against Tomas’s client arose from a search at the defendant’s home address that led to the finding of a large amount of both class A and B drugs, cash, luxury items, and jewellery. Tomas’s client accepted that he was involved in the supply of drugs and relied upon the defence provided at Section 45 of The Modern Slavery Act. The Defendant, an adult, relied on the fact that he was compelled to sell drugs due to exploitation, and that he had no realistic alternative available to him. The trial took place before Luton Crown Court sitting at Huntingdon, and following a three-day trial, the jury returned a unanimous Not Guilty Verdict.
