Victoria Shehadeh, instructed on behalf of the Romanian Judicial Authority, successfully opposed an appeal brought against the order for the Appellant’s extradition to enforce a prison sentence in Romania for fraud offences.
The Romanian authorities had previously attempted to extradite the Appellant six years earlier, and so this was the second attempt. The Appellant argued that the six-year wait between the first and the second attempt amounted to culpable delay and rendered the extradition disproportionate to the Article 8 rights of the Appellant and his family. The High Court agreed with Victoria’s submissions and upheld the decision to extradite the Appellant to serve his sentence.
