Christopher Martin, instructed by Emma Bracewell of DWF Solicitors, successfully defended a van driver charged with causing the death of pedal cyclist by careless driving.
The charge related to a collision, during which the cyclist was killed, when the van struck a bicycle which was riding by the side of the road. The Crown’s case was that the van driver did not afford the cyclist sufficient room when the van driver was preparing to overtake and the cyclist swerved to avoid a drain by the side of the road.
Following a 5-day trial at Chelmsford Crown Court, during which the jury heard a significant amount of expert evidence, Chris’ client was unanimously acquitted.
