At the conclusion of the prosecution case, Tomas McGarvey’s client was acquitted on all counts following a successful submission of no case to answer. Tomas’s client faced an indictment including kidnap, aggravated burglary and three counts alleging unlawful wounding with intent. The prosecution case against Tomas’s client involved evidence that his client used items stolen during a violent burglary, including a bank card, in the hours after the incident. The prosecution also relied on cell site evidence placing Tomas’s client in the area of the incident and following a similar route to the kidnappers. Tomas’s submission was on the basis that the prosecution case was purely circumstantial and no rational jury would be able to reject the possibility of an innocent explanation.
