Stan Reiz KC, instructed by Ayeh Nowroozi of Sweetman Burke & Sinker, represented D who was charged with Attempted Murder, Attempting to Cause GBH and Possession of a Firearm with Intent to Endanger Life.
The prosecution case was that D fired a handgun twice at the complainant from close range. One bullet grazed the man’s hip and the other narrowly missed him. The complainant called the police and named D as the gunman shortly after the shooting.
The gunman’s hooded top was recovered near the scene and found to have D’s DNA on the inside collar. It was also suggested that a CCTV image of the gunman showed he resembled D. D clandestinely left the UK, but was arrested in Italy and extradited nearly 2 years later.
D’s defence was that he was falsely identified as the gunman due to a pre-existing dispute between him and the complainant. Following a 7 day trial, the jury unanimously acquitted D on all 3 counts.
