Rhys Rosser, instructed by Zoe Banfield of JSP Solicitors, has successfully had proceedings discontinued against his 16 year old client ‘T’. T was charged with Section 18 GBH whereby a 14 year old had been the victim of a violent stabbing in the Southend Area, sustaining five wounds during the incident, T was alleged to have been responsible for what was alleged to be a ‘stranger attack’.
Rhys drafted a detailed skeleton argument setting out why the identification evidence relied upon by the prosecution was inadmissible. Relying on breaches of PACE and the viewings of an alleged suspect on social media, Rhys’ argument was such that the prosecution confirmed shortly before trial that they would no longer be proceeding with the offences that T was charged with.
