Sam Thomas represented a 50-year old man facing allegations of being in possession of indecent images. The allegations against the Defendant were technical in nature with three expert witnesses instructed in pursuing the Defence case.
Over the four year history of the case, Sam made a variety of legal arguments including an application to dismiss, multiple applications for disclosure, and a final application to stay proceedings, as an abuse of process. Sam secured incremental success over time, with each legal application successfully reducing the scope of the allegations against his client.
The final abuse of process argument, which related to the prosecution’s failures to meet their disclosure duties in relation to the remaining allegations, was heard at Isleworth Crown Court before His Honour Judge Simon Davis. The Judge reserved Judgment for three hours to allow the prosecution a final opportunity to meet their statutory duties. Unable to meet the final Judicial direction the prosecution offered no evidence against the Defendant who was acquitted of all charges.
