Rhys Rosser represented K, a director of a number of companies who had been made the subject of two multi-million pound personal liability notices. HMRC had alleged that K was part of a Missing Trader Intra Community (MTIC) fraud and as such was responsible for the returns that had been submitted and thus personally liable for the tax owing.
Following an appeal to the tax tribunal and representations from Rhys within a lengthy mediation, HMRC agreed to set aside the personal liability notices and not to pursue matters further against K.
