Rhys Rosser, instructed by Neil Davies and David McChrystal of Caddick Davies Solicitors, appeared before the High Court in a judicial review of a decision to adjourn a trial in R (on the application of William Malone) v Llandudno Magistrates’ Court [2025] EWHC 1740 (Admin). Rhys was successful in arguing that the decision did not properly apply the Criminal Procedure Rules, the previous authorities and was in the circumstances unreasonable.
The decision reviews and restates the principles in respect of adjournments, emphasises the need for rigorous investigation and makes clear the relevance of any previous statements by a party that they are “trial ready”.
Mr Justice Eyre found in favour of the Claimant on both grounds, the decision was quashed and, exceptionally, an acquittal ordered.
