Thomas Daniel successfully represented a 20 year-old defendant in the Court of Appeal on an appeal against sentence and the imposition of a Sexual Offences Prevention Order (SOPO). The appellant had engaged in sexual activity with a 13 year-old girl and the appeal concerned how the courts should approach the categories within Sexual Offences Guideline, as well as what will amount to a “significant disparity in age.”
The sentence was reduced from 30 months’ detention to 12 months’ detention. The Court of Appeal also quashed the 10 year SOPO on the basis it was neither necessary nor proportionate.
