Barry Gilbert and Chris Martin, instructed by Sam Nundy of Levy and Co, successfully defended two paratroop sergeants at a Court Martial lasting two weeks.
Mr Gilbert’s client was charged with sexual assault and perverting the course of justice, Mr Martin’s client was charged with perverting the course of justice. The defence pressed for disclosure of information relating to the prosecution main witness – another paratrooper – and those requests were successful, revealing damning information. Following a submission at the close of the prosecution case the Judge agreed that there was ‘no case to answer’.
The prosecution sought to appeal against the Judge’s ruling. This was successfully opposed by the defence and the defendants were found ‘not guilty’.”
