No further action against CEO of telecommunications provider

Howard Godfrey KC and Alex Davidson were instructed to advise the UK arm of an international telecommunications provider whose CEO was arrested for fraud offences by a national law enforcement agency.

Pre-charge bail conditions initially prevented the CEO from returning to the parent company’s home jurisdiction.  

The parties engaged in lengthy pre-charge engagement which featured expert evidence on the technical capabilities of the company’s telecommunication systems. Representations were drafted by Howard and Alex in conjunction with the company’s solicitor.  

Following a year-long investigation, during which pre-charge bail conditions were successfully challenged, the law enforcement agency decided to take no further action against the CEO or the company.
