Nicholas Maggs’ client acquitted of aggravated burglary and s18 GBH

Nicholas Maggs, instructed by Justine Potter and Chloe Farrow of Credence Law Ltd, represented a man accused of aggravated burglary and s18 GBH.

The prosecution case was that the defendant broke into the complainant’s home during the middle of the night, armed with a meat cleaver. It was alleged that he then entered the complainant’s bedroom and  jumped on to his bed, swinging the meat cleaver at the complainant’s head and causing GBH level injuries to his body. The suspect then ransacked the house, waking several other members of the household, and stole cash.

In the aftermath of the incident, a police chase ensued in the local area with a car linked to the defendant which was said to have been used as the getaway car. Three people within the burgled house identified the defendant as the suspect, as they had known him for several years from the local area.

The defence was that the defendant had been incorrectly identified as the burglar and that he was not driving the car which had been chased shortly after the incident.

After a week long trial at Cambridge Crown Court, the defendant was acquitted of both counts by the jury.
