Olivia Rawlings, instructed by Chloe Goodey at JSP, successfully represented a man of good character accused of ABH arising from a fight in a street in 2022.
The prosecution case was that the defendant attacked the complainants in an unprovoked assault. The defence case was that one of the complainants was the aggressor, that the fight arose from a misunderstanding, and the defendant acted in self-defence.
Following cross-examination of multiple prosecution eyewitnesses over five days, Olivia made “half-time” submissions of no case to answer on the basis that the prosecution’s evidence had been so undermined that no reasonable and properly directed jury could convict the defendant.
The judge agreed with the submissions and directed the jury to return a verdict of not guilty which meant that the defendant retained his good character.
