Murder acquittal – Craig Rush leading Simeon Wallis

Craig Rush and Simeon Wallis, instructed by Michael Rees of Levy & Co, acted for a woman alleged to have murdered her partner. She was acquitted of murder and manslaughter following a two-week trial at Chelmsford Crown Court.

An unusual feature of the case was that the deceased had directly accused the defendant of having killed him. He had been found under a ground floor window by police, and told them that the defendant had kicked him, breaking his ribs, and thrown him through the window. He died at hospital shortly thereafter.

The deceased’s accusation was recorded by police officers on Body Worn Video, and played for the jury in the course of the trial. There was also extensive expert evidence from three pathologists, including a leading specialist in the field of bone and joint pathology. Careful cross-examination established that although the defendant had suffered broken ribs, the evidence in fact pointed away from any of his injuries having been caused by kicking.  The defendant did not give evidence, but the defence succeeded in persuading the judge to leave self-defence to the jury.
