Matt Kingswell successfully represented a man charged with assault occasioning actual bodily harm with an axe. The Crown’s case was that Matt’s client had attacked the complainant within his own home with an axe, causing head injuries. Matt’s client had always maintained that it was the complainant who had tried to attack him, and that he had only acted in self-defence.
Following late disclosure of unused material by the Crown, Matt made a successful application to admit non-Defendant bad character evidence. Following a 3-day trial, Matt’s client was unanimously acquitted by the jury.
