William Clegg QC, instructed by Matthew Frankland of Byrne & Partners is defending a director of Alstom Network UK Ltd who has been charged with corruption contrary to the Prevention of Corruption Act 1906 Act. In a landmark ruling a judge at Southwark Crown Court has ruled that prior to the coming into force of the Anti-Terrorism and Security Act 2001 the1906 Act did not make it an offence to corrupt an agent of a foreign principal or foreign public body even if the physical act of corruption took place within this jurisdiction. The Serious Fraud Office are appealing.
