Fred Batstone, instructed by Paul Cameron and Marcia Lawrence of Bark and Co, represented a defendant acquitted of dangerous driving at Croydon Crown Court.
The Prosecution case was that the Defendant had driven a vehicle dangerously to escape from police, having earlier been spotted by members of the public appearing to slash another vehicle’s tyres. The Prosecution relied on the identification of the Defendant by two police officers ten minutes after the incident. The Defence case was one of mistaken identity.
Fred cross-examined five police officers before making a submission of no case to answer based on the poor quality of the identification evidence. The application was successful and the jury were directed to return a verdict of not guilty.
