Jim Sturman QC represented PN, a fireman charged with causing death by dangerous driving after an accident occurred at a location where he had parked his fire tender so that a chimney fire could be extinguished.
The Judge at Bristol Crown Court directed the jury to acquit after a successful submission that there was no case to answer, ruling that PN was not in fact driving at the time, that even if he had been he was not careless in parking his tender in the position he had chosen and that the actions of another driver amounted to a “novus actus interveniens” so that PN could not be found to have “caused” the death in any event.
