Emergency High Court application to secure client’s release from unlawful detention

Huda Musa (instructed by Steven Levy and Tia Ojo of Levy & Co Solicitors) successfully represented a client facing serious charges.  Her client was acquitted by Westminster Magistrates Court at 7.15 pm on Friday 4 November 2022.

Despite his acquittal, the prison refused to release him claiming it could not be satisfied he should be released and he was transferred to Wandsworth prison. Huda, Tia and Senior Partner of Levy & Co, Steven Levy, immediately set in motion proceedings for a writ of habeas corpus and secured an urgent High Court hearing on Saturday 5 November 2022 (at which Steven appeared), where a full hearing was listed on Monday 7 November 2022. 

Their client was finally released half an hour before the case was to be heard after 66.5 hours unlawful detention. The Court directed that a full written explanation be provided by The Governor of HMP Wandsworth, as to the grounds for detention. Following a written response on behalf of the Claimant and further directions, the Defendant finally conceded that the Claimant’s detention was unlawful.
