David Patience represented the successful Respondent, Transport for London (TfL), in the recent High Court case stated appeal of Biswas v TfL [2025] EWHC 567 (Admin).
The appeal was brought by the operator of a company providing child transport services for various Local Authorities in Greater London, against convictions he had sustained at the City of London Magistrates Court for offences of operating private hire vehicles without adequate licenses in place. The appeal related to the approach to the proper test to be applied by Courts in considering prosecutions under ss.6 and 12 of the Private Hire Vehicle (London) Act 1998 in relation to the meaning of “for hire”, “for the purpose of carrying passengers”, and in relation to the medical function exception.
The appeal was dismissed and TfL awarded their full costs. The full judgment can be read here. David also acted for TfL in the lower court proceedings.
