Alice Bricogne enjoys a multifaceted and international practice, encompassing regulatory, criminal, human rights, sports, and health and safety law.

In addition to appearing regularly in Crown Courts, Magistrates’ Courts and Youth Courts across England, Alice has worked in two offshore jurisdictions, spent three months at the European Court of Human Rights in Strasbourg, and appeared in two appeals to the Court of Arbitration for Sport in Switzerland as well as before the National Anti-Doping Panel in London.

Her particular expertise lies in matters of financial regulation, litigation and white-collar crime. Alice has acquired considerable experience of issues involving AML, CFT, corporate governance and risk management as a result of assisting with a highly confidential financial regulatory investigation for an offshore regulator, as well as through assisting in the defence of a company subject to enforcement action by another offshore regulator. Alice has also advised on the application and implications of the Bribery Act 2010; assisted with the defence of directors being pursued by liquidators, and separately with the defence of a multi-million pound MTIC fraud; and become proficient in the complexities of confiscation proceedings through working at the CPS Proceeds of Crime Unit.

Practice Areas

Appeals

Alice has drafted grounds of appeal for submission to the Court of Appeal, drafted certified questions for an appeal to the Supreme Court, and drafted two applications to the European Court of Human Rights. She has assisted in an appeal against conviction and sentence for a client convicted of a double attempted murder and multiple firearms offences, and in addition has assisted in advising on the merits of an appeal against conviction for an axe murder. She has further advised as to the potential for applying to the Criminal Cases Review Commission and of appealing to the High Court in relation to extradition proceedings.

In addition, Alice has appeared in several appeals from the Magistrates’ Court to the Crown Court, the most notable case being a sensitive appeal against conviction which was heard at Southwark Crown Court and which involved an appellant, complainant and witness who were all deaf and used foreign sign language, necessitating the participation of multiple international and British sign language interpreters as well as the use of various special measures.

Confiscation

Alice has twice been seconded to the Proceeds of Crime Unit at the Crown Prosecution Service, and on both occasions she worked as part of the Enforcement Division. As a result of drafting numerous orders and Letters of Request in a wide variety of cases, Alice has acquired an excellent command of confiscation proceedings, which enables her to provide clear and comprehensive advice to clients.

Crime

Alice is currently assisting in the defence of a client charged with perverting the course of justice. She has previously assisted in cases involving serious violence, including kidnap, false imprisonment, grievous bodily harm by burning and beating, and sexual assault, as well as matters such as blackmail, conspiracy to conceal criminal property, and conspiracy to defraud.

Criminal Defence

Alice regularly appears in the Crown Court, Magistrates’ Court and Youth Court defending clients accused of a broad range of offences involving violence, possession of weapons, drugs, dishonesty, fraud, sex, public disorder, driving and breaches of court orders.

She is currently assisting in the defence of a client charged with perverting the course of justice, as well as with the defence of directors being pursued by liquidators in the context of alleged breaches of directors’ and fiduciary duties.

Fraud

In addition to appearing regularly on behalf of clients charged with benefit and other fraud offences, Alice has assisted in the defence of the managing director of a telecoms company charged with cheating the Revenue of tax in a multi-million pound MTIC carousel VAT fraud.

Health & Safety

In March 2014 Alice was led by Richard Matthews QC in the high profile prosecution of two electricians charged under the Health and Safety at Work Act with negligence in the context of a fatal electrocution. She has previously assisted in the preparation of the prosecution of a Principal Contractor charged with failing to discharge its duties as an employer, as a result of which a man was killed on a building site, and has also been involved in the defence of a company which was indicted after the death of an employee who had been fatally injured by a forklift truck.

International

In 2013 Alice spent three months at the European Court of Human Rights in Strasbourg as a Pegasus Scholar. Working as part of the UK Division of the Registry, she dealt primarily with the highly topical issue of prisoner voting, processing and filtering for admissibility some of the 2,281 applications submitted by disenfranchised citizens in the UK. In addition, she was given an exceptional opportunity to work on communication reports for Chamber cases, which involved considering complaints under Article 5 regarding indeterminate prison sentences for public protection, as well as submissions invoking Articles 6 and 8 in the context of the operation of a barring scheme created by the Safeguarding Vulnerable Groups Act 2006.

Prior to arriving in Strasbourg, Alice had previously drafted two applications to the Court, one on behalf of a Cypriot applicant serving a life sentence for murder, and the other on behalf of an English client convicted of attempted murder and multiple firearms offences.

Murder & Manslaughter

Alice has assisted in advising on the merits of an appeal against conviction for murder, and, during pupillage, assisted Stephen Vullo QC in two murder trials at the Old Bailey, as well as with an appeal against conviction and sentence for a client convicted of a double attempted murder and multiple firearms offences.

Prosecution

Alice has prosecuted in the Crown Court, Magistrates’ Court and Youth Court, and has accepted instructions from the Crown Prosecution Service, the National Probation Service and the Department for Work and Pensions. She was recently led by Richard Matthews QC in the high profile prosecution of two electricians charged under the Health and Safety at Work Act with negligence in the context of a fatal electrocution.

Regulatory

Alice has spent many months working as part of a team of lawyers and AML professionals conducting a highly confidential and sensitive financial regulatory investigation for an offshore regulator, as a result of which she has acquired considerable experience of issues involving AML, CFT, corporate governance and risk management. She is currently assisting in the defence of a company subject to enforcement action by the Guernsey Financial Services Commission, and has thus become familiar with the regulatory laws and procedures underpinning the GFSC’s jurisdiction.

Alice has previously advised an overseas insurance company as to the implications of the Bribery Act 2010 on its business practices, and written the content of an e-learning presentation for a multi-national firm’s in-house anti-bribery training.

In 2013 she was instructed by the Department of Work and Pensions as part of a team tasked with reviewing NHS transfer schemes.

Sports Law

Alice has a keen interest in sports law. She appeared before the Court of Arbitration for Sport in Lausanne as a led junior on two occasions in 2012, and more recently as junior counsel before the National Anti-Doping Panel. She has assisted in the provision of written advice on a wide variety of sports law issues, and is currently writing three chapters of a textbook on football disciplinary procedures, as a result of which she has acquired an excellent working knowledge of the rules and disciplinary procedures of the Football Association, Premier League and Football League.
