Rhys Rosser, instructed by Katerina Tsibouklis of Rustem Guardian, represented W before the Court of Appeal. W was the first defendant on the indictment and had been convicted of Attempted Murder, receiving a 27 year determinate sentence. The facts of the offence involved a group attack where the victim was stabbed multiple times.
Rhys was instructed following a breakdown in the relationship with the legal team at trial and sought to appeal sentence on different grounds to those originally pursued. Rhys successfully argued that the Sentencing Judge took the incorrect approach to the new definitive guideline for the offence and applied insufficient reduction for W’s relative youth and personal mitigation. Following submissions before the full court, the appeal was allowed and W’s sentence was reduced to a 22 year determinate sentence, the lowest sentence imposed on all defendants convicted of the offence.
