Ashraf Khan, instructed by Sam Haldane of JMW Solicitors, London, successfully represented a Metropolitan Police officer before a gross misconduct panel.
The officer had faced allegations of unauthorised access to police systems and disclosure of information. During the course of the proceedings, the Appropriate Authority confirmed it was not pursuing certain aspects of the case, including allegations relating to failure to make declarable associations.
After hearing the evidence, the panel rejected the case advanced by the Appropriate Authority, concluding that there was no proof of misconduct or gross misconduct. The officer was found to have acted in good faith, transparently, and without any breach of the Standards of Professional Behaviour. They were cleared of all charges and their record remains unblemished.
The panel’s decision followed careful preparation of the case and submissions emphasising the circumstantial nature of the evidence, the absence of disclosure or harm, and the officer’s strong record and good character.
