K based in Saudi Arabia and London brought a private prosecution against A who was based in Kuwait. K alleged fraud arising from monies sent from Switzerland by international bank transfer in return for K becoming a goodwill ambassador for an international charitable organisation with observer status at the UN, created to solve the global food crisis, and a diplomatic travel document from the UN. K also alleged fraud against A arising from payments for a formal ceremony and articles to be published in leading business magazines.
K issued a complaint in the Magistrates’ Court which was committed to the Crown Court for trial, but K died before arraignment. A made multiple legal arguments in relation to the death of the private prosecutor, jurisdiction, hearsay and disclosure failures in particular arising from failed High Court proceedings.
Following legal argument the Crown Court concluded that a private prosecution could not survive the death of the private prosecutor, which halted the prosecution.
