Anand Beharrylal KC, leading Kandace Bharath-Nahous (Trinidad), successfully appeared for the respondents in the Privy Council appeal of Ramal & Others v Wheatley and others (Trinidad and Tobago) [2026] UKPC 6. The appeal related to a property dispute between siblings where the appellants were seeking title to the most valuable part of the property to the detriment of the respondents, who were the beneficiaries under a will.
The appeal addressed issues including the overturning of findings of fact at first instance, imperfect gift, propriety estoppel, introducing a new claim on a final appeal and orders for demolition.
Ultimately, whilst the Privy Council were persuaded that the overturning of certain findings of fact and an order for demolition should not have been made by the court below, their Lordships agreed with Anand that the appellants’ claim to part of land and proprietary estoppel could not succeed against the respondents.
