Alex Stein successful in application to dismiss causing death by dangerous driving case

On 25th November 2024 the Honorary Recorder of St Albans, Her Honour Judge Wood acceded to a defence application to dismiss a charge of causing death by dangerous driving against a bus driver following a collision with a pedestrian runner in Hertfordshire in August 2023.

At an earlier hearing HHJ Wood agreed that it was appropriate for the prosecution expert collision investigator to give live evidence at the dismissal hearing. Following cross examination, HHJ Wood described the prosecution expert evidence as weak, and that the prosecution case as a whole as inherently weak and inconsistent.
