Alex Stein and Michael Levy appear in The Pensions Regulator v Dominic Chappell

On 23rd February Dominic Chappell was sentenced for refusing to comply with 3 section 72 Pensions Act 2004 requests issued by The Pensions Regulator following the collapse of British Home Stores in 2016. Chappell was sentenced by District Judge Lucie to a £50,000 fine and was ordered to pay the prosecution costs of £37,000.

This is the 4th conviction under section 77 Pensions Act 2004 and represents a significant increase in the level of fine. The Court stated that the sentence was intended to send a message to those in senior positions within businesses that a failure to comply with section 72 notices will be dealt with seriously.
Both the conviction and the sentence will be the subject of an appeal this summer.

The case was prosecuted by Alex Stein and Dominic Chappell was represented by Michael Levy – both members of the financial crime group in Chambers.
